ARTICLE 1: OUR SERVICE
1.1 Service Overview
The website https://prefev.fr is an online platform that allows users to book chauffeur-driven transportation services (VTC). The Site is published by the company IT SOLVE, registered with the RCS under SIRET number 98201269200017, with its headquarters located at 17 avenue Claude Régaud, 75013 Paris.
1.2 Service Purpose
The Site aims to connect individual or professional clients seeking chauffeur-driven transportation services with professional drivers who have the necessary licenses and insurance to perform this activity.
1.3 Features
The main features offered by the Site include, but are not limited to:
- Creating and managing user accounts.
- Viewing available transportation offers.
- Booking chauffeur-driven transportation services online.
- Secure online payment for booked services.
- Receiving confirmations and notifications related to bookings.
1.4 Terms of Use
Use of the Site is conditioned on the unconditional acceptance of these Terms and Conditions of Use (hereinafter referred to as TCU). Any booking made via the Site implies full and unconditional acceptance of these terms.
1.5 Service Modification
IT SOLVE reserves the right to modify or temporarily or permanently suspend all or part of the Site and its services at any time without prior notice, without this modification or suspension giving rise to any compensation for the user.
ARTICLE 2: BOOKING PROCEDURE AND CONDITIONS
2.1 Account Creation and Booking Options
To book a ride, the user has the following options:
- Booking without an account: The user can make a booking without creating an account. If the user uses an email address already associated with an existing account, the ride will be linked to that account.
- Login: The user can log into their existing account before proceeding with the booking.
- Account creation: The user can choose to create an account before booking a ride by providing accurate, complete, and up-to-date personal information (first and last name, phone number, email).
- Automatic account creation: If the user does not have an account and makes a booking, an account will be automatically created after the booking. An email containing a temporary password will be sent to the user to allow them to log in and customize their account.
The user is responsible for the confidentiality of their username and password and all activities that occur under their account.
2.2 Booking Procedure
In accordance with these TCU, the Client acknowledges that the Services they have subscribed to are available immediately and therefore, pursuant to Article L.221-18 of the Consumer Code, are not subject to the right of withdrawal.
PREFEV reserves the right to suspend the Client's account after a warning if the Client does not comply with their obligations as defined by these TCU.
The booking process on the Site is as follows:
- Route selection: The user enters the pickup and destination addresses.
- Pickup date and time: The user selects the desired pickup date and time. We recommend booking at least 2 hours before the start of each ride to ensure service availability.
- Vehicle choice: The user selects from the available vehicle options based on their needs and preferences.
- Booking details confirmation: The user verifies the booking details, including the estimated fare, schedules, and any additional services.
- Booking validation: The user confirms the booking by clicking the designated button.
2.3 Pricing and Payment
The ride prices are clearly displayed on the Site before booking confirmation. Payments for rides are made online through the secure payment methods offered on the Site. The amount to be paid includes all applicable taxes and any additional fees clearly mentioned during the booking.
2.4 Booking Confirmation
Once the booking is confirmed, the user receives a confirmation email and notification on their user account. This confirmation includes the ride details.
2.5 Modification and Cancellation
The user can modify or cancel their booking under the following conditions:
- Changes requested less than 24 hours before the service cannot be guaranteed. Last-minute adjustments will be considered based on availability and may incur additional costs or fees.
- Booking cancellation before pickup:
- If the client cancels after payment, the following fees apply:
- More than 24 hours before the booking: Full refund.
- Between 6 hours and 24 hours before the service: 50% refund.
- Less than 6 hours before the booking: No refund.
- If the client cancels after payment, the following fees apply:
2.6 Waiting Conditions
- Airports: The first 45 minutes from the scheduled pickup time are free.
- Train stations and other trips: The first 15 minutes from the scheduled pickup time are free.
- Beyond these periods: A surcharge of 1 € per minute will be charged.
2.7 Invoice
The final invoice will be sent by email at the end of the ride.
2.8 User Responsibilities
The user agrees to:
- Provide accurate and complete information during booking.
- Adhere to the agreed-upon pickup times.
- Behave respectfully towards the driver and maintain the vehicle in good condition during the ride.
2.9 Payment Methods
The services booked by the client must be paid for by credit card, as this is the only accepted payment method for individuals. For businesses, payment by bank transfer is also possible.
Payment is made by credit card via Mollie (a secure electronic payment system for managing various online payments). By providing their banking information, the Client agrees in advance and without conditions that IT SOLVE will carry out the secure transaction and authorizes their bank to debit their account for the amount of the service and any additional charges (waiting, parking, additional stops, tolls) after the ride.
The client can choose to save their credit card for all orders. If they do not wish to do so, they must enter their credit card information for each new order.
By providing their banking information, the client agrees that the Company will carry out the secure transaction as soon as they finalize an order. The client thus authorizes their bank to debit their account based on the records or statements provided by the Company.
The booking is considered accepted only after payment validation.
ARTICLE 3: RESPONSIBILITIES AND COMMITMENTS OF THE PARTIES
3.1 Obligations of IT SOLVE
PREFEV undertakes to provide a platform facilitating the connection between clients and professional drivers. PREFEV cannot be held responsible for incidents or accidents occurring during the transport service, as these are the direct responsibility of the driver.
3.2 Obligations of the Driver
The driver agrees to:
- Safe transport: Transport the passenger safely to the destination within the agreed time.
- Liability for damages: Cover direct bodily harm caused to passengers from entering to exiting the vehicle. The driver will not be liable for damages caused by the passenger, a third party, or the nature of the luggage and/or its packaging. The driver must have professional liability insurance.
- Delays: Not provide any compensation or reimbursement for delays due to traffic issues (jams, roadblocks, accidents, detours, weather conditions, various events, etc.). The driver agrees to carefully consider any reimbursement request from a client. This consideration does not automatically entail reimbursement and may result in a credit.
- Vehicle damage: In case of vehicle damage by the client (including vomiting), the client will be held responsible and must pay a flat fee of 150 €.
3.3 User Obligations
The user agrees to:
- Accurate information: Provide accurate, complete, and up-to-date personal information when booking.
- Timeliness: Be present at the agreed time and place for pickup. IT SOLVE cannot be held responsible for any delay initially caused by the user.
- Respectful behavior: Behave respectfully towards the driver and maintain the vehicle in good condition during the ride. In case of vehicle damage by the user, the user will be held responsible and must pay a flat fee of 150 €.
- Payment compliance: Pay for the rides according to the payment terms indicated on the Site.
- Service usage: Use the service in compliance with applicable laws and these terms and conditions of use.
ARTICLE 4: BEHAVIOR IN THE VEHICLE
During the entire ride, all passengers must adhere to traffic rules, particularly regarding seatbelt use.
- Vehicle damage: Any damage caused to the vehicle, such as those resulting from inadvertent door openings, will be charged to the Client.
- Client violations: If the driver observes that the Client is committing a violation, such as drug use, they are required to immediately terminate the service. This interruption will not result in any refund.
- Eating prohibition: Eating is strictly prohibited in the vehicles.
- Onboard safety: It is strictly forbidden to smoke, transport flammable, explosive, corrosive, or toxic substances, or any dangerous goods. The passenger must ensure that their luggage does not contain such substances. PREFEV declines all responsibility for damages caused by luggage or passenger behavior.
- Luggage responsibility: The contents of luggage placed in the vehicle's trunk, especially fragile or delicate items, remain the sole responsibility of the passenger.
- Forgotten items: PREFEV cannot be held responsible for personal belongings and luggage left or forgotten in the vehicle, nor guarantee their return or condition.
ARTICLE 5: COMPLAINTS
Any complaint regarding the service must be sent by registered letter with acknowledgment of receipt within a maximum period of 30 days following the pickup date, to the following address: IT SOLVE, 17 avenue Claude Régaud, 75013 Paris.
ARTICLE 6: APPLICABLE LAW - DISPUTE RESOLUTION
These terms and conditions of sale are exclusively governed by French law.
In case of dispute or claim, the User is advised to contact PREFEV customer service to seek and find an amicable solution either directly online from the "Contact Us" section or by mail to the following address: IT SOLVE, 17 Avenue Claude Régaud, 75013 Paris.
ARTICLE 7: DATA ACCESS RIGHTS AND PRIVACY POLICY
PREFEV collects your data via its website, by email, or by phone.
PREFEV guarantees the confidentiality of your contact details, which will only be shared with third parties as necessary for your bookings. If you have consented to receive our newsletters, you will receive commercial information or updates about PREFEV. Data such as your location, IP address, transactions, and preferences are used solely to improve our booking services and communication with you.
The client can modify their account on the site https://prefev.fr at any time and terminate their user account, with or without reason, by sending an email via our online form. Upon receipt, the account will be permanently closed and any unused credits will be lost.
ARTICLE 8: MODIFICATION OF TCU
PREFEV reserves the right to freely modify the TCU.
Consequently, the Client and/or User is invited to refer to them during each visit to become aware of their latest version, which is always available online on the Platform.
The Client and/or User is then free not to access the Platform if the new conditions do not suit them.
If the Client and/or User does not want the contractual relationship to be governed by the new version of the TCU, they must notify PREFEV and, from the date the new version takes effect, cease using the Platform.
Any modification takes immediate effect and applies only to Users using the Platform after the modification.
ARTICLE 9: ACCEPTANCE
The client acknowledges having read the general terms and conditions of sale at the time of booking.
These TCU are an integral part of the Contract binding the Parties.
The Client and/or User acknowledges having read these TCU, fully understanding their content, and accepting their terms and conditions.
